Help my white '01 is destroyed!!!!

Okay guys some of ya'll know me and some of you have met me but for those who haven't my name is Craig Erickson. The reason for all of this is I need all of your help. At 7:12 AM on January the 16th my 2001 White Lightning was pronounced dead on the scene at an accident in Frisco on 289 and FM720. (not my fault) Since then my beautiful baby was totaled out but the insurance agent is not even going to come close to paying off my once perfect 12,000 mile old truck. So I come to ask for aid from my fellow Lightning owners. If anybody knows a very good, very ruthless, very Lightning oriented Lawyer; Please please please send them my way. As for my current mode of transportation I just bought a red '99 Lightning. I should take delivery this weekend but hopefully will have running proper for the Feb. meeting.
 
Is this "their" insurance agent that is short changing you ?

Have you contacted your insurance company? For either help with this "other" agent, or possibly filling a claim with them (your agent) through your comp coverage.

If you carry full coverage with uninsured motorist, it is really your insurance company's problem.

No the problem is with my insurance company. They say that my truck was only worth 29,000. That leaves me 3,000 and change in the hole. As for his insurance company they haven't even contacted me. I don't even know if this guy even has insurance. The Frisco police dept. hasn't even supplied me with a police report yet. So if this guy's insurance company doesn't settle up with the difference for my truck as well as the rest of my bills I'll have to take him to court. But getting back to my insurance comp. they did some kind of survey and the 29,000 is the best they say they can do. I've even got uninsured motorist as well as everything else but gap insurance.
 
Did you buy an 01 or 99 red L? Give us some figures of what they are offering you owe etc... I would get with your ins company and hopefully they will help you fight for "fair market" value. When new my ins company said my 01 total loss pymt would be 25K, 7K short of sticker I paid 2 hours earlier. But I learned they had to pay fair market repl value which would be higher. Or maybe your financing on the truck left you owing more than the value? It happens a lot now days especially on leases and long term no down pymt loans. That is how I learned about GAP insurance. Don't sign or accept anything until you and your advisors feel that is it. wheew out of breath now. I know it is a bitch but it will be in the past soon :rolleyes:
 
I have looked at every option. 29,130.67 is the best figure they can give me. I guess I just paid to much. But my new/old L is a '99. Red. Not much to look at now but give me a couple of months and it'll be a red blur!

I hate to say this, but your gonna have to help push this through.
Don't wait for them to contact you. Get down to the Police station and get 2 copies of the report. Send one, hand deliver one to your insurance agent. Get him to settle up the differnece if needed.
Since it was not your fault, I'm surprised that your insurance is taking the lead.
Unless, this guy didn't have insurance.
Was he driving a personal vehicle or company car?

YOU need the facts. Get whatever info you can from the Police report.

Don't wait, thinking these folks are gonna jump hoops to help you. They will bend you over, given the chance.
 
But see thats the problem. I've been trying everyday to get a report from the po pos. I call them at least three times a day. They keep telling me that the officer working the case is off or they can't find any info. they are really starting to piss me off. And as far as waiting my insurance comp did everything but. I can't get them to even slow down to get a report. They just want to finish and move on and if it means screwing me in the process then that is what they are gonna do. About the only thing that can get me back now is to go after this guy who I don't even know. I'm going to try to get his insurance to make up the difference and then some. If that doesn't work this guy is going to wish he never even got up this year.
 
Damn think you would have learned with the first 99' :D 29K? Is that what they offered or you bought the new one for? 29K and 99' don't even belong in the same state... invoice on an 01, 02 is 28.8K. Unles it is a black GoRila edition then they are worth way over 29K, LOL.

Sorry to hear about your accident. Hope everything goes ok. It should considering you have another L and 5 grand in your pockets.

Did the insurance company let you keep your truck? I was wondering because I wanted to know if you are going to part your L out.:D
 
My neighbor's ex-husband is PD in Frisco. I'll see if I can pull some strings and get you your police report.

It is not required that you file a claim with your insurance company. If you know 100% that it is not your fault you can file a claum with the other parties insurance company.

If you file with yours they settle with you, charging you your deductabe till they get there mone from the other insured. This clain stays on your record from that point on. The clasification will change IF they get the money from the other party/insurance company.
 
Couple of thoughts.....

1. Frisco PD is required to submit the accident report to DPS within 10 days of the accident. So, if this occurred on 1-16, then they are required to have the report completed by tomorrow.

2. If you're upside down in your '01, that's your problem, not your insurance companies, unless you have gap insurance. Cruel, but that's the way it is.

3. If the $29,100 is actually current fair market value on a used 12K '01, then that's all you can expect to get. On the other hand, if you can demonstrate that current fair market value is over that, then you can/should argue for that figure. Having just sold a used car, I learned that right now the used car market is VERY depressed, so $29K may not be unreasonable.

Guess that was more than a couple thoughts. Forgive me.
